Terms of Service

These terms govern the services provided by The Hedge Fund Garden Maintenance (ABN 21 512 911 322) ("we", "us", "our") and your use of this website. By engaging us or using this website, you agree to these terms.

1. Services

We provide garden maintenance, landscaping, and related outdoor services. The exact scope of work for any given job is set out in the quote we give you before work begins. Variations to scope must be agreed before they are carried out.

2. Quotes

Quotes are valid for 30 days from the date issued unless otherwise stated. Quotes are based on the information provided at the time of inspection or enquiry. If conditions on the day of work differ materially from what was quoted (for example, hidden obstacles, undisclosed garden volume), we may need to revise the quote before continuing.

3. Bookings and cancellations

Once a job is booked into our schedule, we ask for at least 48 hours' notice of cancellation or rescheduling. Late cancellations may attract a fee equal to the agreed call-out, where the slot cannot be re-filled.

Weather-related rescheduling at our discretion does not incur a fee. We will let you know as early as possible.

4. Payment

Payment terms are stated on each invoice. Standard terms are 7 days from invoice date unless otherwise agreed. We accept bank transfer; other methods by arrangement.

Late payment may attract recovery costs, including reasonable legal and collection fees, in addition to the original amount owed.

5. Site access and safety

You agree to provide safe access to the property at the agreed time, including:

• Unlocking gates and securing pets
• Disclosing hazards (electrical, irrigation, fragile structures, unmarked utilities)
• Identifying any plants, fixtures, or features you don't want touched

We carry public liability insurance and operate under standard workplace safety practices. We are not responsible for damage caused by undisclosed hazards or pre-existing conditions on the property.

6. Property and plants

Landscape and garden work involves living material. While we apply industry best practice, we cannot guarantee plant survival in every condition, especially where:

• Plants are stressed, diseased, or already in poor health when we begin
• Weather (drought, frost, storm) damages the work after completion
• The site is not maintained as we recommend after our visit

If plants fail within an agreed warranty period stated on the quote, contact us and we'll discuss replacement options.

7. Photos and content

We may take photos of our work for our portfolio, website, and social media. We do not photograph people, vehicles, or anything that identifies a property's owner or address unless you specifically consent. If you would prefer we don't photograph your job at all, let us know in writing before we start.

8. Limitation of liability

To the extent permitted by law, our total liability for any claim arising out of or in connection with the services is limited to the amount paid by you for the specific job giving rise to the claim. We are not liable for indirect, consequential, or economic loss.

Nothing in these terms excludes or limits liability that cannot be excluded or limited under the Australian Consumer Law, the Competition and Consumer Act 2010 (Cth), or any other applicable law.

9. Australian Consumer Law

Our services come with consumer guarantees that cannot be excluded under the Australian Consumer Law. These include guarantees that services will be:

• Provided with due care and skill
• Fit for any specified purpose
• Delivered within a reasonable time (where no time is set)

If we fail to meet a consumer guarantee, you may be entitled to a remedy under the Australian Consumer Law. Nothing in these terms is intended to limit those rights.

10. Privacy

How we collect, use, and protect your personal information is set out in our Privacy Policy.

11. Website use

This website is provided "as is". We make no warranty that the website will be uninterrupted or error-free. Content on the website is for general information; quotes and service terms are confirmed individually for each job.

12. Intellectual property

All content on this website (text, photography, video, design) is owned by The Hedge Fund Garden Maintenance or used under licence. You may not reproduce, copy, or use it for commercial purposes without written permission.

13. Governing law

These terms are governed by the laws of New South Wales, Australia. Any dispute will be resolved in the courts of New South Wales.

14. Changes

We may update these terms from time to time. The "Last updated" date at the top reflects the most recent version. Continued use of our services after a change indicates acceptance of the updated terms.
